Regulations of the Sister's Aroma online store

 

1.    Terms and definitions

1.1.  Regulations – these Regulations. The current version of the Regulations is available at the following link: https://eu.sistersaroma.com/oferta/. Performing any actions on the Website means the Consumer agree without any reservations with these Regulations.

1.2. SellerSister’s Aroma Sp. z.o.o. with headquarters at Warsaw, Poland, 00-831, Twarda 44 str.; КRS: 0000990359; NIP: 5273017918; REGON: 523030588. The seller is also the owner and administrator of the Website. For additional information, the Consumer can contact the Seller at the following phone number: +48 833 131 973.

1.3. Price – a value expressed in the monetary unit of Polish zlotys (PLN), which the Consumer are obliged to pay to the Seller for the Good(s). The prices listed on the Website are gross (including VAT).

1.4. Registration Form – a form that is available on the Website that allows consumers to create a Consumer Account.

1.5. Consumer – a person with whom an Agreement may be concluded within the meaning of Article 22 (1) of the Civil Code of the Republic of Poland and other laws of the European Union.

1.6.  Account – a personal account of the Consumer with the help of which the Seller collects the data provided by the Consumer and sells the Good(s). With the help of the Account, the Consumer can:

-        place an Order, buy Good(s), and conclude an Agreement;

-        exercise the right to return or exchange the Good(s), which is provided for in clause 8.3. and clause 8.7. of these Regulations.

1.7. Shopping Cart – the electronic shopping cart of the Website, where the Consumer check or edit data about the Good(s), as well as, if necessary, finishes placing the Order and concludes the Agreement.

1.8. Privacy and Confidentiality Policy –  a document that defines the provisions regarding the processing of personal data. The full text of the Privacy and Confidentiality Policy can be found at the following link: https://eu.sistersaroma.com/privacy/. Performing any actions on the Website means that the Consumer agree without any reservations with the Privacy and Confidentiality Policy, in particular, such consent may be expressed by creating an Account by the Consumer, filling in the Registration Form, purchasing Good(s), etc.

1.9. Good(s)  – a movable item from the category of Good(s) or services available on the Website, which the Consumer can purchase.

1.10.    Website – https://eu.sistersaroma.com/. Using the Website, the Seller sells Good(s) to Consumers, informs about promotions and Good(s), posts up-to-date documentation that regulates relations with the Consumer, etc.

1.11.    Agreement – an agreement concluded remotely under clauses 1 and 2, Article 2 of the Consumer Rights Law of the Republic of Poland and other laws of the European Union, the subject of which is the sale of Good(s) to the Consumer. The Agreement is binding from the moment the Consumer make a payment for the Good(s) and the Seller sends the confirmation to the Consumer under the procedure specified in clause 5.7. of these Regulations.

1.12.   Order – the Consumer's request to purchase the Goods through the Website. To place an Order, the Consumer should provide the following information:

- first name and surname;

- information about the Good(s);

- phone number;

- e-mail address;

- the full address of delivery of the Good(s).

The Order is placed to purchase the Good(s) from the Seller, as well as conclude the Agreement. The order can be placed via the Account or in another way determined by these Regulations. Reading these Terms and Conditions, the Privacy and Confidentiality Policy, as well as their acceptance by the Consumer is obligatory to purchase the Good(s) on the Website.

 

2.    General provisions

2.1. These Regulations define the rules for processing Orders, selling/returning Good(s), as well as other conditions.

 

3.     Creation of an Account

3.1. Registration and creation of an Account takes place by filling out the Registration Form by the Consumer. The Registration Form must contain:

- first name and surname of the Consumer;

- Consumer's e-mail address;

- Consumer's phone number;

- Consumer's current location;

- Consumer’s date of birth;

-  the address of residence (delivery) of the Good(s) including the postal code;

- other additional information (at the request of the Consumer).

Login to the Account is carried out by entering a login and password.

3.2. Before completing the process of creating the Account, the Consumer should read the Privacy and Confidentiality Policy and these Regulations. The condition for completing the registration (creation) of the Account is the acceptance by the Consumer of the provisions of the Privacy and Confidentiality Policy and these Regulations.

3.3. The Consumer undertake not to disclose his login and password to third parties, which is necessary for logging into the Account. The Consumer are liable for access to the Account by third parties in case of disclosure of the login or password.

3.4. The Consumer acknowledge that to create an Account, it is necessary to provide his data, as well as to ensure their authenticity.

3.5. The Consumer can delete his Account at any time without explaining the reasons and without being charged any fees. In the event of deletion of the Account, all data will be deleted, except for those necessary to process complaints, inquiries, requests, or suggestions. The Consumer's data contained in the Seller's tax documents and related documents will be stored until the expiration of the limitation period for tax obligations under the tax legislation of the Republic of Poland and the law of the European Union.

 

4.    Technical requirements for using the Website

4.1. To obtain a full  experience with the Website, including viewing the available assortment of Good(s), services and placing an Order, etc., one must have:

a) mobile device, computer, or tablet with access to the Internet;

b) an active email account;

c) enabled cookies under the information outlined in the Privacy and Confidentiality Policy;

d) mobile phone number.

4.2. The Seller hereby informs that the public nature of the Internet and the use of electronic services may lead to the risk of receiving and changing the Consumer's data by unauthorized persons, therefore, appropriate measures should be taken to minimize the above-mentioned risks. In particular, the Consumer must use anti-virus programs and programs to protect the identity of Internet users. The Seller never asks the Consumer to provide him with a password to his Account in any form.

4.3. The Consumer acknowledge that the refusal to accept the provisions of the Privacy and Confidentiality Policy or these Regulations may lead to restrictions of the Consumer in the purchase of the Good(s) and the exercise of other rights provided for by these Regulations.

 

5.    Conclusion of the Agreement

5.1.  The creation of the Account is not obligatory to place an Order and purchase Good(s) (to conclude the Agreement) on the Website.

5.2.  Placing an Order is the Consumer's desire to enter into a Purchase Agreement with the Seller.

5.3. To place an Order, the Consumer need (without creating the Account):

- visit the Website;

- choose Good(s) from the assortment, the price of which is accepted by the Consumer, and select Add to Cart”;

- select “Proceed to place order”;

- specify first name and surname;

- enter e-mail address and phone number;

- provide information about the delivery address within the Republic of Poland and/or the European Union;

- choose one of the available payment methods (to conclude the Agreement);

- complete the Order.

5.4. To form an Order, the Consumer need (without creating the Account using an email address and/or phone):

- visit the Website;

- choose Good(s) from the assortment, the price of which is accepted by the Consumer, and call the number: +48 833 131 973 or write an e-mail to the e-mail address: support.eu@sistersaroma.com. When placing an Order by phone or e-mail (by correspondence with the Seller's representative), the Consumer must provide the following information:

- information that will allow identification of the Good(s) and their quantity;

- first name and surname;

- e-mail address and phone number;

- delivery address within the Republic of Poland and/or the European Union;

- choose one of the available payment methods (to conclude the Agreement);

- complete the Order.

5.5. To form an Order, the Consumer need (with the creation of the Account):

- visit the Website;

- create or log into the Account by entering login and password;

- choose Good(s) from the assortment, the price of which is accepted by the Consumer, and select Add to Cart”;

- select “Proceed to place order”;

- provide information about the delivery address within the Republic of Poland and/or the European Union;

- choose one of the available payment methods (to conclude the Agreement);

- complete the Order.

5.6.  Before completing the Order, the Seller specifies the total cost of the Good(s) that the Consumer plan to buy and the terms of delivery of the Good(s). Depending on weather conditions or other factors that may affect the delivery time, the delivery time of the Good(s) may be changed.

5.7. After the completion of the Order and receipt of payment for the Good(s) from the Consumer (conclusion of the Agreement), the Seller provides the Consumer with the confirmation and informs the Consumer about the shipment of the Good(s). Confirmation is carried out by sending an e-mail to the e-mail address specified by the Consumer when placing an Order or by sending a message via WhatsApp to the User Account to which the Consumer's phone number is assigned. The confirmation includes information about the assortment of the Good(s), their price, time of delivery, and other information related to the Good(s).

5.8. The Seller has the right to partially or completely refuse the sale of the Good(s) to the Consumer and the conclusion of the Agreement with the Consumer, if:

- the Seller temporarily does not have the required Good(s);

- the Consumer fail to provide information about the delivery address of the Good(s);

- the delivery address of the Good(s) is not within the Republic of Poland and/or the European Union;

- the Consumer fail to provide their first name and surname;

- the Consumer fail to provide their email address and phone number;

- For two business days in a row, the Seller unsuccessfully tried to contact the Consumer via the e-mail address or telephone number provided by the Consumer to clarify the data.

5.9. The prices on the Website, which are placed next to the Good(s), are gross and do not include the cost of delivery (if delivery is paid) to the Consumer and any other costs that the Consumer will be required to bear in connection with the purchase of the Good(s) and the conclusion of the Agreement.

5.10.   The Seller reserves the right to update the prices of the Good(s) available on the Website, however, the price valid at the time of placing the Order remains unchanged for the Consumer.

 

6.     Payment procedure

6.1. Detailed information on available payment methods can be found at the following link https://eu.sistersaroma.com/delivery-payment/. The Good(s) can be sent to the Consumer only after 100% prepayment.

6.2. To place an Order and pay for the Good(s) online, the Consumer must have the necessary amount of funds on the bank card, taking into account the costs of delivery to the Consumer.

6.3.  The Consumer agree that the Seller issues electronic receipts/invoices in pdf format, which are confirmation of payment for the Good(s) and conclusion of the Agreement. Such electronic receipts/invoices are sent to the email address specified by the Consumer when placing the Order.

6.4. The Good(s) can be sent to the Consumer only after 100% prepayment.

 

7.    Delivery of the Good(s)

7.1. The Good(s) are delivered by the Consumer within the Republic of Poland and the countries of the European Union by the courier companies listed at the following link: https://eu.sistersaroma.com/delivery-payment/. The Consumer acknowledge and agree that each unit of the Good(s) may be delivered at different times and on different days. For each or several shipments of the Good(s), the Consumer will receive a separate confirmation. When the shipment with the Good(s) is ready for shipment, the Consumer will receive an e-mail or SMS message with a tracking link.

7.2. The Good(s) purchased through the Website cannot be picked up stationary (at the Seller's store, representative office, office, branch, etc.).

7.3. During the actual transfer of the Goods to the Consumer, the latter is obliged to accept and inspect the Goods. In the event of detecting faults, defects, or deficiencies, the Consumer have the right to draw up an appropriate protocol with a representative of the courier company and/or refuse to accept the Good(s). In such a case, the Consumer are also entitled to the rights specified in clause 8.3 or 8.7 of these Regulations.

 

8.    Return of the Good(s) and termination of the Agreement

8.1. The Seller undertakes to provide the Consumer with Good(s) without defects, which can be used for the purposes provided for similar types of good(s), unless the Consumer were aware of such defects. The seller is liable for faulty Good(s) under the conditions outlined in the current legislation of the Republic of Poland and Directives of the Council of the European Parliament No. 2011/83/EU dated October 25, 2011 and No. 2019/771EU dated May 20, 2019.

8.2. The Seller does not provide a guarantee for the Good(s) purchased by the Consumer through the Website. However, some Good(s) have expiration dates.

8.3. The Consumer have the right to return the Good(s) to the Seller without explanation within 14 (fourteen) calendar days from the moment of payment for it. In this case, the Consumer have the right to:

- to receive the full amount for the paid Good(s) (if the Good(s) were not used), including for the delivery of the Good(s) to the Consumer;

- to receive money for the paid Good(s) that were used with a reduction in the refund amount as a result of its use by the Consumer, including for the delivery of the Good(s) to the Consumer.

8.3.1. The Consumer acknowledge and agree that the Good(s) can be returned to the Seller in the same way as it was last sent to the Consumer. It is impossible to return the Good(s) to the Seller's store, branch, office, or representative office, etc.

8.4. Costs connected with the returning of the Good(s) to the Seller (courier services, packaging and returning the Good(s) to the Seller, etc.) in the case provided for in clause 8.3. of these Regulations are covered by the Consumer at their own expense.

8.5.  The seller satisfies the demand under clause 8.3. of these Regulations and reimburses the money to the Consumer, provided that the Consumer return the Good(s) and the Seller receives them. The reimbursement is carried out after inspection of the Good(s) and within a reasonable period, but not longer than 14 (fourteen) calendar days from the moment the Seller receives the Good(s) from the Consumer, specified in clause 8.3. of these Regulations. The Seller has the right to deny the Consumer the satisfaction of his right provided for in clause 8.3. of these Regulations if they sent (returned) to the Seller other Good(s) than the ones that were declared for the return.

8.6.  The Consumer cannot use the right provided for in clause 8.3. of these Regulations if:

- The Consumer have agreed that they will receive defective, used, or soon-to-be-expired Good(s). Usually, Good(s) of this type are sold at a lower (promotional) price than similar non-defective and new goods;

- The product is non-disassemblable, manufactured according to the Consumer's order, or intended for individual needs;

- Good(s) that are perishable or have a short shelf life expiration date;

- Good(s) that were delivered to the Consumer in a sealed package, which cannot be returned after its opening for reasons of health or hygiene, were opened after the actual delivery to the Consumer;

- the Consumer have not followed instructions of the Good(s);

- in other cases provided for by the legislation of the Republic of Poland and the law of the European Union.

8.7.  If the Consumer discover defects (faults) in the Good(s), the Consumer have the right to:

- to replace the defective Good(s) with similar Good(s) or to reduce the cost of the Good(s);

- to return the Good(s) to the Seller and get reimbursement of the funds;

- to get the defects of Good(s) revomed by the Seller.

8.7.1. The Consumer acknowledge and agree that the Good(s) can be returned to the Seller in the same way as it was last sent to the Consumer. It is impossible to return the Good(s) to the store, branch, office or representative office of the Seller.

8.8.  The costs of replacing defective Good(s) or removing defects of the Good(s) shall be borne by the Seller.

8.9. The seller satisfies the requirement stipulated in clause 8.7. of these Regulations within a reasonable period without any inconvenience to the Consumer. The Seller satisfies the claim and/or reimburses the money to the Consumer specified in clause 8.7. of these Regulations, provided that the Consumer return the Good(s) and the Seller receives it. Such monetary compensation/replacement/removal of defects of the Good(s) is carried out after inspection of the Good(s) and within a reasonable period, but not longer than 14 (fourteen) calendar days from the moment of receipt by the Seller from the Consumer of the Good(s) specified in clause 8.7. of these Regulations. The Seller has the right to deny the Consumer the satisfaction of their right provided for in clause 8.7. of these Regulations if they sent (returned) to the Seller different Good(s) than the ones that were declared for the return or replacement.

8.10.   The Seller may refuse to satisfy one of the Consumer's rights, which is provided for in clause 8.7. of these Regulations if it is economically impractical to remove the defects of the Good(s), and it is economically feasible to provide the Consumer with similar Good(s). The Seller may also refuse to replace defective Good(s), if there is no such Good(s) in the Seller's warehouse. In this case, the Consumer will be refunded within 14 (fourteen) calendar days from the moment of receipt of the request (requirement) from the Consumer, provided for in clause 8.7. of these Regulations.

8.11.   To exercise the right specified in clause 8.3. and clause 8.7 of these Regulations accordingly, the Consumer must apply to the Seller with a corresponding application (request/requirement):

- by writing an e-mail to the e-mail address: support.eu@sistersaroma.com

8.12.    The application specified in clause 8.11. of these Regulations must contain:

8.12.1. in the case provided for in clause 8.7. of these Regulations:

- first name and surname of the Consumer;

- the Consumer's contact phone number and e-mail address;

- the date of detection of a defect in the Good(s);

- proof of purchase of the Good(s) from the Seller;

- a summary of the circumstances.

8.12.2. in the case provided for in clause 8.3.of these Regulations:

- first name and surname of the Consumer;

- the Consumer's contact phone number and e-mail address;

- proof of purchase of the Good(s) from the Seller;

- a summary of the circumstances.

8.13.   The Seller is obliged to provide a response to the Consumer's application (request/requirement), which was submitted under clauses 8.3 and 8.7. of these Regulations within 14 (fourteen) calendar days. If the answer is not provided by the Seller within the above-mentioned period, the request is considered satisfied.

 

9.    Pre-judicial (out-of-court) consideration of complaints

9.1. Detailed information on the Consumer's ability to apply a pre-judicial (out-of-court) method of handling complaints is available on the Websites of district (city) Consumer rights commissioners. Link to the Office of Competition and Consumer Protection: https://uokik.gov.pl/.

9.2. The Consumer have the following rights to resolve a dispute with the Seller:

- an appeal to the permanent court under Article 37 of the Trade Inspection Law of the Republic of Poland;

- appeal to the provincial inspector under Article 36 of the Trade Inspection Law of the Republic of Poland.

9.3. The Consumer can get free help in resolving the dispute with the Seller by using the free help of the county (city) ombudsman for consumer rights.

9.4. To settle the dispute amicably, the Consumer can also use the EU ODR online platform https://ec.europa.eu/consumers/odr/main/?event=main.home2.show

 

10.    Personal data protection

10.1. The policy on the processing of personal data is available at the following link: https://eu.sistersaroma.com/privacy/.

 

11.    Final provisions

11.1. The content of this Regulation is available to anyone free of charge and without any time limits.

11.2. The Regulations may be amended in the following cases:

- to adapt these Regulations to the applicable law;

- in the event of a change in the rules of operation of the Website and the sale of Good(s) (conclusion of the Agreement);

- in the event of a change in the procedure of payment, delivery, or return of the Good(s);

- in the event of a change in the functioning of the Website, which occurred due to security reasons.

11.3. Each Consumer who have an Account will be informed about changes to these Regulations by sending an e-mail to the e-mail address previously specified by them. Such notifications will be sent no later than 30 (thirty) calendar days before the entry into force of changes to these Regulations. If the Consumer do not accept the new changes, they have the right to refuse them. In this case, the Consumer acknowledge that such a refusal may lead to restriction or refusal by the Seller to use the Website or purchase the Good(s) (conclude the Agreement).

11.4. The Consumer are obliged to use the Website in a way that meets the requirements of the law and morality, and not to distribute illegal content. In case of violation of the specified clause, the Seller has the right to limit or block access to the Website, as well as to refuse the sale of the Good(s).

11.5. With this Regulation, the Seller informs the Consumer that all content on the Website is a work within the meaning of the Copyright and Related Rights Law of the Republic of Poland and other normative acts of the law of the European Union. The Seller informs the Consumer that the distribution by the Consumer of the content without the consent of the Seller, except for the use of the content within the framework of permitted personal use, is a violation of the intellectual property rights of the Seller and may lead to liability under the legislation of the Republic of Poland and other regulatory acts of the law of the European Union.

11.6. The Regulation is governed by the legislation of the Republic of Poland and other regulatory acts of the law of the European Union.
